This Acceptable Use Policy sets out the conduct required of the Customer and its Authorized Users when accessing or using the Actaa Service, and forms part of the Platform Terms of Service.
01 Scope
This Acceptable Use Policy ("AUP") is incorporated into the Platform Terms of Service and applies to all use of the Actaa Service by a Customer and its Authorized Users. Capitalized terms have the meanings given to them in the Terms. The Customer is responsible for the compliance of its Authorized Users with this AUP.
02 Prohibited Content
The Customer shall not use the Service to store, process, or transmit content that:
- Is unlawful, or that violates or infringes the intellectual property, privacy, or other rights of any person;
- Is harmful, including malware, ransomware, or other malicious code, or content designed to disrupt or damage systems;
- Facilitates fraud, deception, or unlawful activity; or
- The Customer lacks the rights or, where required, the consents necessary to process within the Service.
03 Harassment and Discrimination
The Customer shall not use the Service to harass, threaten, defame, or abuse any person, or to engage in unlawful discrimination. This obligation applies both to content stored within the Service and to the manner in which the Service is used in relation to individuals, including employees, applicants, and other persons whose personal data the Customer's organization processes within the Service.
04 Security and Tenant Isolation
The Customer shall not attempt to undermine the security or integrity of the Service or of any other customer's data. In particular, the Customer shall not:
- Attempt to breach, test, or circumvent security controls, authentication, access controls, or per-company data isolation, or access data that does not belong to its organization;
- Probe, scan, or penetration-test the Service without the prior written authorization of Nomisma;
- Scrape, harvest, or bulk-extract data or content other than its own Customer Data through supported means; or
- Reverse-engineer or attempt to derive source code, except to the extent this restriction is prohibited by applicable law.
05 Fair Use of the Service
The Customer shall not misuse the Service or degrade it for others. In particular, the Customer shall not:
- Overload, flood, or interfere with the Service or its infrastructure, or attempt a denial-of-service;
- Circumvent usage limits, AI budgets, or the fail-closed spend gate;
- Resell, sublicense, or provide the Service to third parties without the authorization of Nomisma, or use it to build a competing service; or
- Remove or obscure proprietary notices, or misrepresent its affiliation or authority.
06 Artificial Intelligence and Employment Decisions
The AI Features are assist-only. The Customer shall not use them to make unlawful decisions, and shall not treat AI output as a fully-automated decision-maker where applicable law requires human judgment.
07 Enforcement and Consequences
Where Nomisma reasonably believes that this AUP has been violated, it may take action proportionate to the violation, including:
- Removing or disabling access to offending content;
- Suspending an Authorized User's access or the account, in whole or in part; or
- Terminating the Agreement for material or repeated breach, as provided in the Terms.
Where a violation creates an urgent security or legal risk, Nomisma may act immediately and provide notice thereafter. Where practicable, Nomisma shall provide notice and an opportunity to cure beforehand. Nothing in this AUP limits Nomisma's other rights under the Platform Terms of Service or at law.
08 Copyright and the DMCA
Nomisma responds to notices of claimed copyright infringement in accordance with the U.S. Digital Millennium Copyright Act ("DMCA").
A notice of claimed infringement should be sent to info@actaa.ai with the subject line "DMCA Notice" and must include:
- a physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
- identification of the copyrighted work claimed to have been infringed;
- identification of the material claimed to be infringing, with information reasonably sufficient to locate it on the Service;
- your address, telephone number, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
- a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on their behalf.
Upon receipt of a compliant notice, Nomisma will remove or disable access to the material and notify the member who posted it. That member may submit a counter-notice containing the elements required by 17 U.S.C. § 512(g)(3), in which case the material may be restored unless the complainant commences an action seeking a court order. Nomisma maintains a policy of terminating, in appropriate circumstances, the accounts of members who are repeat infringers.
09 Law-Enforcement and Legal Requests
Nomisma requires valid legal process before disclosing member or Customer data to law enforcement, and discloses only what that process compels.
- Requests should be sent to
info@actaa.aifrom an official government email address, on official letterhead, and must identify the requesting agency, the legal authority relied upon, and the specific data sought. - Nomisma requires a subpoena, court order, or search warrant appropriate to the category of data requested, as required by applicable law.
- Where Nomisma acts as a processor for a workspace, requests for that workspace's Customer Data are referred to the Customer as controller, except where Nomisma is legally prohibited from doing so.
- Nomisma notifies the affected member or Customer of a request before disclosure, unless prohibited by law or where notice would create a risk to life or safety.
- Nomisma will preserve data pending legal process where required, and will refuse or narrow requests that are overbroad, defective, or legally insufficient.
Emergency disclosure requests involving an imminent risk of death or serious physical injury should be marked "Emergency Disclosure Request" and will be assessed on receipt.
10 Reporting and Contact
Suspected abuse, a security concern, or a violation of this AUP may be reported to info@actaa.ai. Reports are investigated promptly, and Nomisma does not disclose a reporter's identity to the party reported on except where required by law.
